taking a live look at the u.s. capitol dome. it has been be busy there over the past couple of days. the house finally passing a compromise on the fiscal cliff. we're going to have more on that coming up in a report. good morning, everyone. i'm sarah simmons. >> i'm wisdom martin. welcome to fox 5 morning news. before we get to that, we want to get to tucker barnes and find out what's happening outside in the weather world. >> good morning. >> good morning. >> i'm not sure everybody is going back to work, everybody going back to work and and school today. weather is going to be quiet, looking fine. generally dry conditions out there. it is cold. kids going to the bus stop, that kind of thing, they're going to want the winter coat. oh, yeah. temperatures in the 30s. it's going to be a cool couple of days around here, but we should be dry for much of the remainder of the week. let's go to the radar. with the exception of our friends to the south and east across lower eastern shore, see down towards salisbury and ocean city, a couple of leftover sprinkles and light snow flurries. the rest of us are looking at dry conditions. we have a cold front that's driving through the area and it

will continue to bring us some cloud cover here for the next couple hours. gradually we should see more and more sunshine today, something we haven't seen a lot of in the last few days. it'll be partly to mostly sunny afternoon, and seasonal, temperatures will be in the low 40s. nothing too extreme here. temperature at reagan national, 37 degrees. dulles 34. bwi marshall 34. here's your forecast for today, plenty of afternoon sunshine after a chilly start, highs in the low 40s. again, that's about where we should be for the second day of january and no need for a rain coat or winter boots or anything like that. we're not expecting any precipitation today. >> just a big puffy warm coat, that's all. >> you definitely want to be warm, yeah. >> and a hat maybe. >> hat weather is here to stay. >> thanks, tucker. time to check in with julie wright. julie wright, how's our commute this morning? >>reporter: so far so good, wisdom. no accidents to report just yet. nice and quiet on the roads as we continue to get the morning stretch and get out of bed. today is one of those days you don't want to get out of bed. 66 fair oaks heading inbound, incident free as you continue in toward the capitol beltway.

you'll also find lanes open northbound on i-95, but traffic behaving nicely northbound out of staffford. no issues 610 headed out towards quantico. a nice easy trip south of 118 headed out towards rockville. here we are at the american legion bridge. outer loop looks great coming out of montgomery county. that's a check of your fox 5 on time traffic. >> thank you, julie. late last night house lawmakers approved a fiscal cliff deal. it will avoid tax hikes for middle class americans and delays across the board spending cuts. >> the bill is now on its way to president obama who is expected to sign the bill into law. fox 5's melanie alwick is live on capitol hill this morning with a closer look at the deal. melany. >>reporter: wisdom, you know, it was definitely a nailbiter all day here on capitol hill, despite the bipartisan approval in the senate early on new year's day, passage in the house was definitely not

certain, and as the evening wore on, hill watchers were starting to get a little nervous. it was literally the 11th hour, 11:00 last night when house speaker john boehner finally put the senate version up for a vote. it passed 257-167 with mostly democratic support. for much of the day house republicans argued over whether to change the bill by tacking on spending cuts and send it back to the senate. senate leaders warned that would blow apart the entire deal. now, the bill means that taxes will only go up on americans making $400,000, couples making $450,000 and that's fewer people than president obama initially wanted. it also extends long-term unemployment benefits, fixes the alternative minimum tax and prevents a spike in dairy prices. it delays the $109 billion in automatic spending cuts for two months. >> under this law more than 98% of americans and 97% of small businesses will not see their income taxes go up.

millions of families will continue to receive tax credits to help raise their kids and send them to college. companies will continue to receive tax credits for the research that they do, the investments they make and the clean energy jobs that they create. 2 million americans who are out of work but out there looking, pounding the pavement everyday are going to continue to receive unemployment benefits as long as they're actively looking. >>reporter: so there will be no big bill signing ceremony here. shortly after that late night press conference, president obama left washington to resume his vacation in hawaii. we're told that he can sign that bill by auto pen or the bill can be known to hawaii for his signature. now, as we mentioned, this certainly did not have a lot of republican support. 2-1 republicans in the house voted against this measure, concerned that there weren't spending cuts attached to it and with very little faith that those spending cuts will actually materialize without

political pressure. and as we know, this is setting up quite a big budget battle for the next two months. back to you guys. >> melanie alwick reporting live. thank you so much. checking our top stories this morning, classes will resume tomorrow for students and teachers of sandy hook elementary who survived last month's tragic shooting. classes will be held in another building near the school in newtown, connecticut. experts say it is important for children to get back into a routine and for teachers and parents to offer reassurance. 20 children and six adults were killed at the school on december 14th. a community gathered to honor fallen prince william county police officer chris young. his motorcycle collided with a minivan on route 28 in brifto while responding to a call on new year's eve. both vehicles caught on fire, as you can see from this photo here. two citizens pulled him from the wreckage, but he died at a local hospital. the two women in the minivan are expected to be okay, and so far no charges have been filed. officer young worked with the department for seven years. he leaves behind a wife and

three children. still ahead on fox 5 morning news, you know the start of the new year has a lot of people wondering what their future holds. and 2013 has one city reconsidering its ban on fortune tellers. first, though, a difficult start to the new year for one church community devastated by a fire. we're going to tell you what members are focusing on this morning when we come back. time now is 5:07.

new this morning, a virginia police officer is part of a new presidential panel created in the wake of the newtown, connecticut school shooting. veedersburg police chief john dixon, iii is a member of the gun violence task force. the group is working with vice president joe biden to help control gun violence. the panel met for the first time last month. foul play is not suspected in a church fire in pridges georgia's county. flames broke out at the first wesleyan church in oxen hill saturday morning. no one was hurt, but it has severe damage. the neighborhood reportedly lost power during a service on new year's eve night and power wasn't restored until after everyone left. >> we're very sad. this is our church. we were here last night and we

had such a grand celebration. you know, we welcomed in the new year and now here we are again and our church is destroyed. >> fire officials estimate the damage to be more than $100,000, but it will likely cost much more than that to rebuild the church. members are now looking for a temporary home. coming up next, what does the future hold for 2013? well, in one montgomery county city, you may soon be able to go to a fortune teller and get some answers. but right now we're going to get some answers from our -- >> our fortune teller. >> yes. >> and the weather crystal ball. hey, we got clouds out there to start your day, temperatures in the 30s. it's going to be a chilly day today, but we should be dry and the best part, more sunshine than we've seep in days. i'll have more details on your weather and julie has your traffic coming up after the break. k.

welcome back. 5:14 right now. you know, most of us wonder what the future holds, especially this time of year. today officials in gaithersburg will look into overturning the city's ban on fortune tellers. fortune telling businesses are not allowed right now under montgomery county zoning law. however, that law was struck down by the maryland court of appeals which said it was a restriction of free speech. if it's approved, the mayor and council could vote on overturning the ban later on this month. let's look into our crystal ball and see what we can find

out about outside. >> we know it's cold. >> wouldn't a fortune teller be able to tell us if the law was going to be overturned? >> you can't talk to one there because apparently they're banned. you might have to cross the river into virginia to find one. >> if they knew it was going to be overturned, they would have moved there and started their business back up. >> right. that's true. >> we're full of useless information. >> very, very confusing. we better move on to weather. >> a cold start to your day, temperatures in the 30s, parts of the region falling back near the freezing mark. going to be your typical chilly january 2nd. highs in the low 40s, but best news, more sunshine in the next couple of days. won't be hard, we didn't see a whole lot yesterday. >> it doesn't take much to make us happy. >> let's do temperatures and we get started with a look at reagan national. we are now 37 degrees. so we've fallen another degree here in the past hour. 36 in annapolis. leonardtown, good morning, you're 36 degrees. and there's the freezing temperatures there to the north and to the west. gaithersburg 32, fredrick 32, hagerstown, good morning,

you're 28 degrees, and, let's see, fredricksburg 39. couple light sprinkles, light snow flurries south and east of us, down across the lower eastern shore. i think you get across the bay before any of this is touching the ground. but it is certainly a possibility if you're watching in southern maryland, lower eastern shore, you could be dealing with a few snow flurries, maybe a few sprinkles here early. this is all part of our cold front. if you were watching yesterday, remember the cold front was moving through and that was bringing us the cloud cover. this will continue to press to the south and east today. so after morning cloud -- i keep getting in the way of this map. after morning clouds, we should gradually see more and more sunshine building in, and all the green you see, all the rain shower activity you see on the map, that will be pushed out to sea. so nice looking afternoon. plenty of sunshine, high temperatures expected to be in the low 40s. hey, if you haven't noticed, nice, quiet week. not expecting any big storms this week. in fact, most of the week featuring a very dry pattern here. we do have a bit of a dip in the jet stream and that's going to be responsible for a couple chilly days around here.

so temperatures for the remainder of the week here will be in the 30s and low 40s. that's close to where we should be for this time of year. and then a warmup expected by early next week. 41, winds north and west here five to 10. a little breezy at times. becoming sunny. kind of a cool afternoon, but with more sunshine, it should feel better than the last couple of days. 30 tonight, a few clouds, cold overnight. lots of 20s tomorrow morning. winds north and west at five. here's your accuweather seven- day forecast, thursday, friday, saturday, sunday, monday, maybe even tuesday, pretty impressive, i can say all the names of the week, by tuesday looks like we'll be near 50 degrees. that's weather. let's do some traffic. julie wright is back. and we're all happy to see julie. yay, julie. >>reporter: there's something going on there. i don't know what it is, but there's something going on. inbound new york avenue at ballottensburg road, we're happen to see traffic flowing freely. stopped here temporarily at the stoplight, but that's it. third street tunnel, all lanes open. kenelworth avenue moving

smoothly as well. top stretch of the beltway off to a quiet start leaving coldsville road headed over towards 270. southbound 270 great going no problems to report coming out of germantown, headed for the lane divide. this is i-95 at 17, headed through staffford, volume increasing, lanes open, no problems reported across the occuquan. that's a check of your fox 5 on time traffic. >> julie, thank you. new this morning, tragedy on the streets of l.a. a paparazzi was hit and killed by a car moments after taking photos of justin beiber's ferrari. he was not in the ferrari at the time. it was parked on the side of a road. the photographer was struck as he walked across a busy boulevard after taking the pictures. a long list of new laws went into effect on both state and federal levels on new year's day. fox's shannon bream has a closer look at some of them. >>reporter: as a new year begins, hundreds of state and federal laws and regulations

are phasing in, ranging from amusing to highly controversial. as of today, a regulation from the department of health and human services issued in conjunction with the new healthcare law requires employers to provide health insurance to make sure it includes free access to birth control, including controversial methods some argue can actually cause an abortion. though there is an exemption for religious employers, there are more than 40 lawsuits now pending, brought by those who say they meet the criteria but that the obama administration is refusing to recognize their status, including hobby lobby which lost its supreme court pid for an emergency -- bid for an emergency injunction last week. at the state level legislators passed more than 29,000 new measures in 2012 including these. in concord, massachusetts, there's now a ban on selling bottled water. california has outlawed the use of dogs to hunt bobcats and bears. there are a number of employment-related measures as well. in oregon, it's now illegal for employers to advertise a job opening if they won't consider applicants who are currently

unemployed. and in both illinois and california, it's now illegal for employers to ask for or require you to hand over the passwords to your social media accounts like facebook and twitter. that goes for both applicants and current employees. other states have already enacted similar laws. and you know that old signal flashing your headlights to let an oncoming driver know there's a speed trap ahead? as of florida, as of today, you can no longer get a ticket for doing that. in washington, shannon bream, fox news. coming up next, trying to shed some pounds in the new year? who isn't? there's another good reason to swap out that soda for a healthier choice. find out why sugary drinks may actually trigger overeating. >> that's what my problem is. also ahead, with lots of students heading back to school today after the long holiday, hear what medical experts are saying about the importance. fox 5 morning news is back in a moment. >> can we have recess? >> and some sugary drinks too.

and in virginia fairfax county will collect trees the first two weeks of january. arlington county's curbside collection, that starts on the 7th. just be sure to remove the stand and all the decorations too. you don't want to leave those behind. >> yes. or you can just put it back in the box like i do mine every year. got some gift cards burning a hole in your pocket? january 4th through the 6th is gift card weekend. some businesses are offering savings, special deals to people who pay with gift cards. that includes amc theaters, applebee's, um, ribs, both bath and bodyworks and olive garden. >> they want people to use those cards. >> good eats. >> yeah. the new year brings a bigger pay check for some people. the city with the highest minimum wage in the country is hiking it again. >> workers in san francisco got a raise. fox's carla lu has the details.

>>reporter: at left odeul's in union square, workers welcomed the rise in the city's minimum wage. >> i mean, it's not going to be a lot different, but it's going to help on things, you know. >>reporter: santiago arks diehard 49ers fan who works full time as a cook says the bump to $10.55 an hour will help his family of four. >> for the toll plaza, you know [ indiscernable ] that's really good. >>reporter: lisa sanchez, a patron who tends bar at a different restaurant agreed. >> it could be like a bill over the month, that's a bill, that's my cable bill. it helps for sure. >> it'll make it a little more difficult for us to meet. we'll have to watch our costs more. it will help out the staff that lives on minimum wage and need two jobs, so that will help. >>reporter: some argue the increase may hurt businesses and could mean fewer jobs. others including labor expert

harlan shaken says otherwise. >> what's often overlooked is things attracting a higher of w benefiting in the bay area because there's more purchasing power in the economy because the working poor spend every penny. >> that was fox' caralu reporting. with the increase to $10.55 an hour, workers in san francisco now make more than $3 above the federal minimum wage which stands at $7.25 an hour. in this morning's health alert, a potential reason why some of us are packing on the pounds. a new study found that fructose can trigger brain changes that may lead to overeating. scientists say the brain doesn't register the feeling of being full after people drink a fructose beverage as it does when simple glucose is consumed. high fructose corn syrup is a sugary substance added to many processed food and beverages. doctors maintain recess is crucial for kids in more ways than one.

pediatricians say recess should be a part of every kid's day and never be taken away as a form of punishment. a new study finds that children just like adults need ample time to decompress during the day. there are also physical benefits, especially when you consider more than 1/3 of u.s. children are overweight. many families welcomed new babies on new year's day, laying claim to the title of the first baby of 2013 in our area, a baby girl born at holy cross hospital in silver spring, maryland. she was born right at midnight, weighing in at seven pounds and six ounces. another baby girl born five seconds later, after midnight, five seconds after midnight, can call january 1st her birthday too. she was born at med star washington hospital in the district. and coming in at third place, but still just as cute, her competition, another baby girl born at 2:43 new year's morning at shady grove adventist hospital. big congratulations to the all proud moms and dads out there

it is 5:31 right now. let's take a live look out at the woodrow wilson bridge, shall we? we haven't seen that in a while. look, the traffic is picking up out there, meaning everybody is getting back to work on january 2nd here, 2013. it's going to be a cold start to your day as well, but, tucker, we'll have some slight, gi es, peeks of sunshine, right? >> well, more and more sunshine as the day goes on. so maybe even mostly sunny by afternoon. i mean, it should be a nice looking day. >> good. >> it's going to be typical january with highs only in the low 40s here. but with a lot of sunshine and dry conditions the next couple of days, you know, smooth sailing. >> it's going to be cold. i'll take the sun at least.

>> right. yesterday was chilly and we didn't have any sun, so today should feel a little better for you. let's kick off by looking at our radar. we've had a few light sprinkles and light snow flurries to our south and east this morning. they are quickly falling off the map there or pushing east. they're not literally falling off the map. there you go, you can kind of see those out towards ocean city and salisbury. locally we'll be very quiet here. we do have closure that remains as our cold front is a slow mover and off to the north and west some clearing and sun will take place. so the trend will be more and more sunshine here for your wednesday. and it should be a decent afternoon with mostly sunny conditions, and as mentioned, some cooler air has moved in, so our highs will only be in the low 40s. take a look at the temperature map, right now at reagan national, 37. you want to see cold air? hey, it feels like january in places like columbus, ohio. 11 degrees this morning. chicago 13. new york city just 23. so we're in on the last of the relatively warm air here. we are going to be -- i don't want to say unseasonably cold, but we are going to be a little below average here temperature

wise for the next couple days. here's your forecast. daytime highs about 40 here in washington, maybe 41 in much of the area, particularly north and west we'll be in the 30s with sunshine, so chilly day. >> yes, it is. all right, tucker, thanks. time now to say hello once again to julie wright. hey, julie. >>reporter: hey, guys. starting to get which isy. down at the wilson bridge seeing the volume increase. now we've got accidents to discuss. eastbound on the dulles toll road before you commit at wolf trap, the right side of the roadway is blocked. fire units are on the scene eastbound headed toward the capitol beltway. let's go ahead and pull up our camera. we had had an accident reported along route 50 east of the beltway in maryland at 424 davidsonville road. i'm finding traffic that moving smoothly each way at this point, traveling between annapolis and the capitol beltway. let's continue with the cameras. we'll show you what's happening, southbound 270 picking up the volume now leaving 109 out of hy attstown. lanes open here, no issues reported southbound headed towards the beltway. 395 at the 14th street bridge, car tying up the left lane.

that's a check of your fox 5 on time traffic. and now to a news alert this morning. late last night the house agreeing to pass the so-called fiscal cliff plan with a vote of 257-167. the bill to avoid tax hikes for middle class americans and spending cuts is now on its way to the president for his signature. in order to pass the bill, the house agreed to abandon its request for additional spending cuts. despite approval from the house, some lawmakers argue it is setting the stage for even more work to come in the next few weeks. meanwhile, president obama urging both parties to find a better way to work together. >> we set up three more fiscal cliffs. we're gonna have to deal with the debt ceiling, we're going to have to deal with the continuing resolution expiration and we're going to have to deal with the sequester. and all that's left is spending cuts. dism the one thing that i think hopefully in the new year we'll focus on is seeing if we can put a package like this together with a little bit less

drama, a little less brinksmanship, not scare the heck out of folks quite as much. we can come together as democrats and republicans. >> now, despite the agreement, another battle is looming. in february congress will have to decide on raising the country's borrowing limit. and after days of dealing with fiscal cliff negotiations, president obama is on his way back to hawaii to finish his vacation. the president left late last night. the obamas began their annual end-of-the-year vacation on december 21st, but mr. prom was forced to return to the white house last week for fiscal cliff talks. the obama family returns to the white house this coming weekend. the fiscal cliff compromise is being hailed as a victory for middle class families too, but you'll still take home less pay this year. the payroll tax which is the amount taken out to go to social security will return to $6. -- 6.2%. for the past two years it had been lowered to 4.2%. for an average family making $50,000 a year, this means

happening now, a rise in the number of measles cases in children in pakistan. the world health organization says 300 children died from the disease in 2012 compared to 64 in 2011. a pakistani health official says the disease hit hardest in poorer communities in and around the country where families did not vaccinate their kids. now many pakistanis, especially in rural areas see vaccines as a western plot to sterilize muslims. pakistani officials are now launching an immunization campaign to prevent further outbreaks. a new year's celebration on the ivory coast took a tragic turn. 61 people were killed and more than 200 hurt when revelers panicked after a fireworks

display and started a stampede outside a stadium. many of the dead were children and teenagers. the ivory coast president and his wife toured a hospital where many survivors are being treated. he declared a day of mourning. the hunt is still on for four masked gunmen who robbed an apple store in paris, france. they forced their way into the store three hours after closing time on new year's eve and took everything from iphones and ipads to mac computers. then they escaped in a van. there are reports that the stolen merchandise is worth well over $1 million. >> yeah, i bet it is. still ahead, president obama's second inauguration is less than three weeks away, and we're going to take a look at how preparations are going for the big day. we've also got tucker and his forecast. and julie has another look at the roads. fox 5 morning news is back in a moment. temperatures are on the cool side and we hit the freezing mark here north and west in many communities here. fredrick 32. good morning hagerstown, you're 28 degrees. 31 this morning in martinsburg, 32 in winchester. so, again, particularly north and west here temperatures falling near the freezing mark. still warmer to the south, quantico 38 degrees. one or two light snow showers and/or sprinkles south and east of town here. there we go, down towards salisbury. i'm not sure all of this is touching the ground. but if you're headed in that direction or waking up down near ocean city today, you may encounter a light snow flurry or a light shower here. this is all associated with a cold front, again, it continues to press to the south and east. it'll quickly be out of here and drag with it eventually the cloud cover. i no he we still got clouds out there -- i know we still got clouds out there at the moment. if you look to west virginia, we're starting to see breaks in the clouds. and we should see more sunshine, a lot more sunshine later today than we've seen in the last couple of days. it will be a nice day. it'll be a cool day, high

the dulles metro project. preparations continue for president obama's second inauguration. by law he has to be sworn in on january 20th. that's a sunday this year, so it will take place in a private ceremony. now, the public events will be held on monday, january 21st. construction has been under way on the inauguration platform at the u.s. capitol for several weeks now and the military is heavily involved in the ceremony as well. thousands of servicemembers from all branches will help with everything from security to serving as ushers. the crowds aren't expected to be as large as president obama's first inauguration, but that isn't toning down the excitement. >> it's not everyday you get to watch history happen and that's one of the things that folks here on inauguration day will be able to see. >> you can follow inauguration preparations on our website. there's a link on myfoxdc.com. coming up -- also coming up sports breakfast. >> we've got a wrap of all
